1. Scope

1.1 Subject Matter

These General Terms and Conditions (GTC) apply to the use of the Discord bot "LootGoblin" (hereinafter "Bot") and all related services.

1.2 Contracting Parties

Provider: Florian Janke (private, non-commercial side activity)

1.3 Applicable Law

German law applies, excluding the UN Sales Convention.

2. Service Description

2.1 Bot Functions

The bot offers the following functions:

• Automatic posting of game deals
• Configurable platforms and channels
• Premium features (for a fee)
• User settings and wishlist

2.2 Premium Features

Premium features include:

• Extended deal filters
• Auto-threads
• Deep-search
• Custom webhook names
• Extended wishlist limits

2.3 Availability

The bot is operated with 99% availability. Outages due to maintenance or force majeure are possible.

3. Prices and Payment Terms

3.1 Premium Prices

• Premium Subscription: €1.99/month (or equivalent in other currencies)
• Lifetime Premium: Upon request (only via promo codes)

Note: Prices are for private side activity, not commercial activity. No VAT (small business regulation).

3.2 Payment Processing

Payment is made via:

• Stripe (credit card, SEPA, etc.)
• Discord Server Subscriptions (if available)

3.3 Payment Terms

For subscriptions, payment is made monthly in advance.

3.4 Price Adjustments

Price adjustments will be announced at least 30 days in advance.

4. Contract Conclusion

4.1 Subscription Conclusion

The contract is concluded by completing a premium subscription via Stripe or Discord.

4.2 Confirmation

After successful payment, premium is automatically activated.

5. Cancellation

5.1 Cancellation by User

The user can cancel their subscription at any time:

• Stripe: Via the Stripe customer portal
• Discord: Via Discord server settings

5.2 Cancellation by Provider

The provider can cancel the subscription with 30 days' notice.

5.3 Immediate Cancellation

Immediate cancellation is possible in case of serious violations.

5.4 Consequences of Cancellation

After cancellation, premium features remain available until the end of the paid period.

6. Right of Withdrawal

6.1 Right of Withdrawal for Consumers

Consumers have a right of withdrawal of 14 days from the date of contract conclusion.

6.2 Exceptions

The right of withdrawal does not apply to:

• Immediately provided digital content (if consented to)
• Already used premium features

6.3 Withdrawal Information

The withdrawal information will be provided at the time of contract conclusion.

6.4 Refunds

Refund Policy:

• Refunds are possible within 14 days of purchase (right of withdrawal)
• In case of technical problems: Contact support (contact@loot-goblin.xyz or Discord)
• In case of cancellation: No refund for already used time
• Already used premium features exclude a refund
• Refunds are made via the same payment method as the original payment

7. Liability

7.1 Disclaimer

The provider is not liable for:

• Losses due to bot outages
• Incorrect deal information (from third-party providers)
• Data loss (backups are recommended)

7.2 Limitation of Liability

Liability is limited to intent and gross negligence.

7.3 Product Liability

Product liability remains unaffected.

8. Privacy

The privacy provisions can be found in our Privacy Policy.

9. Dispute Resolution

9.1 Online Dispute Resolution

The European Commission provides a platform for online dispute resolution (OS): https://ec.europa.eu/consumers/odr/

9.2 Consumer Arbitration

We are not willing or obliged to participate in dispute resolution proceedings before a consumer arbitration board.

10. Final Provisions

10.1 Changes to the GTC

Changes to the GTC will be announced at least 30 days in advance.

10.2 Severability Clause

If individual provisions are invalid, the validity of the remaining provisions remains unaffected.

10.3 Place of Jurisdiction

Place of jurisdiction is Gütersloh for consumers, Gütersloh for entrepreneurs.
